【摘要】 为了更好地保障生育，各地在2021年《人口与计划生育法》修改之后，都通过修法或者推行各种政府扶助措施，借此激励生育意愿。作为给付行政范畴的扶助措施，虽具有较强的政策性、引导性特征，但其是否需要法律调整、需要何种法律边界，仍应在法治维度加以思考。特别是考虑到政府生育扶助的公共属性，应强调以女性和家庭为核心的扶助措施，并在其中贯彻公平性、辅助性原理，进而实现通过法律建构生育友好型社会之目标。更多还原

【Abstract】 With the aim of better ensuring childbirth,after the amendment of the Family Planning Law,local governments have been modifying relevant laws and implementing various government assistance measures to stimulate the willingness to have children. Essentially,these assistance measures fall within the scope of administrative benefits. Although they possess strong policy-oriented and guiding characteristics,questions such as whether they require legal regulation and what kind of legal boundaries are needed still demand consideration from the perspective of the rule of law. Particularly,given the public nature of government childbirth assistance,it is necessary to emphasize that women and families should be the core beneficiaries of these assistance measures. Moreover,principles of fairness and subsidiarity should be implemented to achieve the goal of constructing a birth-friendly society through legal means.更多还原
