【摘要】 宅基地使用权跨集体流转具有激活宅基地财产价值、盘活宅基地闲置资源、促进乡村振兴的现实作用。目前各地试点立法虽已从条件、程序、用途管制、收益分配以及受让人权利保障等方面，搭建了宅基地使用权跨集体流转的制度框架，但仍在转让方的身份限制、“一户一宅”准入条件、受让方在新住地的法律地位以及收益分配的制度逻辑等方面存在缺陷。未来的改革应当坚持“稳慎推进”宅基地资源市场化配置原则，立足“提高资源配置效率”,优化宅基地使用权跨集体流转规则，明确受让人的“特殊成员”地位及其权利保障机制，完善利益分配机制，平衡农户、集体、政府三方利益关系。更多还原

【Abstract】 The cross-collective transfer of the right to use rural residential land holds practical necessity in activating the property value of homesteads, revitalizing idle homestead resources, and promoting rural revitalization. Currently, pilot legislations across regions have established an institutional framework for the cross-collective transfer of the right to use rural residential land, encompassing aspects such as conditions, procedures, durations, methods, usage regulations, revenue distribution, and safeguards for transferees′ rights. Nevertheless, there remain deficiencies in terms of the identity restrictions on transferors, the "one household, one homestead" entry criterion, the legal status of transferees in their new residences, and the institutional logic of revenue distribution. Future reforms should adhere to the principle of "prudent advancement" in the market-oriented allocation of homestead resources, optimize the rules for cross-collective transfer of the right to use rural residential land based on "improving resource allocation efficiency, " clarify the "special member" status of transferees and their rights protection mechanisms, and improve the revenue distribution mechanism to balance the interests of farmers, collectives, and governments.更多还原
