【摘要】 体育行政裁量权基准是保障体育行政机关公正、公平行使裁量权的关键要素，对于提高体育行政执法水平具有重要意义。运用文献资料、专家访谈、实地考察等研究方法，系统分析我国体育行政裁量权基准发展态势，对当前所面临的现实问题进行分析，并提出优化策略。研究认为，我国体育行政裁量权基准呈现出制度逐步跟进、政策逐渐完善，应用领域不断增多、辐射范围不断扩大，公开性逐步提升、透明性逐步加大的发展态势；但仍面临常态化制度体系不够完备、基准内容过于笼统、应用难度不断加大、应用效能滞后、监督评价力度偏低等现实问题，无法有效适应当前体育行政执法“控权保民”的发展需求，在一定程度上削弱了体育行政管理的公信力。基于此，提出建立常态化管理机制、优化基准尺度和标准、明确适用领域和范围、提高体育行政执法服务能力、优化监督评价机制的策略，以期提升体育行政裁量权基准的实施效果，提高我国体育行政执法水平，助推体育法治高质量发展。更多还原

【Abstract】 The benchmark of sports administrative discretion is the key element to ensure that sports administrative authorities exercise their discretionary powers impartially and fairly, and it is of significant importance for enhancing the level of sports administrative enforcement. By employing methods such as literature review, expert interviews, and field investigations, this paper systematically analyzes the development trends of the benchmark of sports administrative discretion in China, examines the current issues, and proposes optimization strategies. This study finds that the benchmark of China’s sports administrative discretion exhibits development trends characterized by gradual institutional alignment, progressive policy improvement, expanding application areas, broader coverage, increased openness, and enhanced transparency. However, it still faces the current issues,including an underdeveloped normalized institutional system, overly general benchmark content, increasing application difficulty, lagging implementation effectiveness, and insufficient supervision and evaluation, which hinder its capacity to meet the current governance demand of “controlling power while protecting the people” in sports administrative enforcement, thereby undermining the credibility of sports administrative management. In response, this study proposes strategies such as establishing a normalized management mechanism, optimizing benchmark scales and standards, clarifying applicable fields and scope, improving the service capacity of sports administrative enforcement, and optimizing supervision and evaluation mechanisms. These strategies aim to enhance the implementation effectiveness of the benchmark for sports administrative discretion and improve the level of sports administrative enforcement in China, thereby promoting high-quality development of sports governance under the rule of law.更多还原
