【摘要】 英国《2006年诈骗罪法案》将诈骗犯罪由结果犯变更为行为犯值得关注和研究。民事欺诈的行为构造与刑事诈骗的行为构造基本吻合。以非法占有目的和民事救济可能性来区分刑事诈骗与民事欺诈并不妥当。必须严格依据刑法规定与相关司法解释认定涉案行为性质，先检测涉案行为是否符合诈骗犯罪的表象构成要件，再进一步检测是否存在排除犯罪性或责任的辩护事由。可从以下方面把握涉案行为性质：从国家刑事司法政策立场正确把握涉案行为性质；交易主体是否真实且具有实质内容；行为人是否有真实合法履约行为；不能履约是否有合理解释或事出有因；是否有足额担保；被害人是否了解或知道交易中的虚假信息；是否已进入民事处理程序或者已通过民事诉讼程序结案。更多还原

【Abstract】 It is worthy of attention and research that the Fraud Act 2006 of UK has changed fraud offenses from the result-based crime to the behavior-based crime. The behavioral structure of civil fraud is basically consistent with the that of criminal fraud. It is not appropriate to distinguish criminal fraud from civil fraud by the purpose of illegal possession and the possibility of civil remedy. The nature of the behaviors involved in cases must be determined in strict accordance with the provisions of the Criminal Law and relevant judicial interpretations. The first thing is to test whether the behavior involved in the case matches the appearance of constituent elements of fraud offenses, and then further test whether there is any defense to exclude illegality or culpability. The nature of the behavior involved in the case can be grasped from the following aspects: to correctly understand of nature of the behavior involved in the case according to the national policies and standpoints on the criminal judicial practices; whether the transaction subject is authentic and there is substantial content in the transaction; whether the actor has really and legally performed the contractual obligations; whether there is reasonable explanation or suitable causes for the nonperformance; whether the full guarantee is set; whether the victim knows or understands the false information in the transaction; whether the civil dispute-resolving process has been initiated or the issue has been concluded through the civil proceedings.更多还原
