【摘要】 在线异步审理是一种新型的法院审理方式，但也面临程序性质不清晰、违反直接言词原则、冲击集中审理原则、难以全面发挥纠纷解决效果的质疑。在线异步审理对现行审理模式产生的影响为，在实质上构成对法院审理形式的内部拓展，成为开庭审理的一种新的形式。但其不会影响现行审理模式对直接言词原则、集中审理原则以及终局性纠纷解决理念的追求。需在规范中调整开庭审理的内涵、强化直接言词原则于在线异步审理中的贯彻、突出在线异步审理对公正效率的价值追求以及优化在线异步审理纠纷解决的功能，完善在线异步审理的规则。更多还原

【Abstract】 Online asynchronous trial is a new way of court trial, but it also faces the question of unclear procedure nature,violation of the principle of direct speech, impact on the principle of centralized trial, and diffculty to ful y exert the effect of dispute resolution. The effect of online asynchronous trial on the current trial mode is that it essentially constitutes the internal expansion of the court’s trial form and becomes a new form of trial. However, online asynchronous trial wil not affect the current trial mode’s pursuit of the principle of direct speech, the principle of centralized trial and the concept of fnal dispute resolution. It is necessary to improve the rules of online asynchronous trial by adjusting the connotation of the court trial, strengthening the implementation of the principle of direct speech in online asynchronous trial, highlighting the value pursuit of fairness and effciency of online asynchronous trial, and optimizing the function of online asynchronous trial dispute resolution.更多还原
