【摘要】 在全球化风险时代下，健康权作为一项基本人权备受瞩目。在国际人权法下，健康权概念的不断完善凸显人格自主、人格尊严等价值观念的持续落实。我国制定相关民刑事法律规定和卫生健康具体法规，给予公民必要的救济，保障公民的健康安全，增进社会的民生福祉。我国大陆与台湾地区目前分属不同的法域，对公民健康权的保障措施有所不同，但同样为维护公民健康权益而不断完善自身法规。同时，在新时代高速发展的背景下，两岸需迫切回答和解决健康权功能规范的完善及健康权保护的时代新挑战问题，为公民的健康权益保驾护航。更多还原

【Abstract】 In today’s world of globalized risk, the right to health as a basic human right has attracted much attention. Under the international human rights law, the continuous improvement of the concept of the right to health highlights the continuous implementation of values such as personal autonomy and human dignity. Under the guidance of the Constitution, Chinese mainland and Taiwan formulate relevant criminal laws and specific regulations on health and health, give necessary relief to citizens, protect the health and safety of citizens, and improve the livelihood and well-being of the society. Compared with the similarities and differences of the protection of the right to health on both sides of the Taiwan Strait, although Chinese mainland and Taiwan have different measures to protect citizens’ right to health, they also continue to improve their own laws and regulations in order to protect the health rights and interests of citizens.
