【摘要】 目前，我国行政规范性文件审查监督体系已经具备多元共治的基本形态，但由于审查要求不可及、审查标准同质化等制度缺陷的存在，导致实践中出现了人大“备而不审”、法院规避审查、行政内部审查虚置等制度失灵的现象。究其根本，在于对机构能力有限性和差异性的忽视。因此，可根据主体权力分工和职能特点的差别，在合法性审查的共性要求之下，设置差异化的审查标准和监督重点，形成多元主体审查职责的合理分工，为衔接机制的建构和功能性整合的实现提供前提性的制度支持。更多还原

【Abstract】 At present, the review and supervision system of Administrative Normative Documents in China has obtained its basic form of multiple co-governance. However, due to the institutional defects such as unreachable review requirements and homogenization of review standards, there have been institutional failures in practice, such as lots of normative documents submitted for recordation would not actually being reviewed by the National People′s Congress, some local courts evading judicial review and administrative internal review vacancy. The fundamental reason lies in the neglect of the limitations and differences in institutional capabilities. Therefore, according to the differences in the division of power and functional characteristics of the subjects, and under the common requirements of legality review, differentiated review standards and supervision priorities can be set up to form a reasonable division of responsibilities of the multi-subject review, and provide a preliminary institutional support for the construction of cohesion mechanism and the realization of functional integration.更多还原
