中国药品专利补充实验数据判断标准最新进展探究

【摘要】 本文结合中国国家知识产权局(CNIPA)2021年1月修订的《专利审查指南》对补充实验数据的审查标准、最新的司法判决和行政决定，对药品专利中有关补充实验数据判断标准进行了解读。

【Abstract】 Based on combination of the “Patent Examination Guide”(2021) revised by China National Intellectual Property Office(CNIPA) and the latest judicial and administrative decisions, this paper interprets the latest examination standard of whether supplementary experimental data can be accepted in pharmaceutical patents.
