【摘要】 对426件一审适用认罪认罚从宽制度后进入再审的案件进行分析后发现,认罪认罚从宽制度在节约司法资源、实现“案结事了”等方面发挥了重要作用,并且保证了绝大多数案件定罪问题上的实体公正,但也存在四个明显的问题:量刑错误时有发生、重罪案件量刑不当风险较高、法官对案件实质审查不足、对被追诉人的程序保障不足。出现上述问题的主要原因在于认罪认罚从宽制度的实施机制不够健全、制度设计不够完善。应从完善诉讼衔接制约机制、强化法律帮助机制、优化检察机关办案业绩考核机制三个方面改进实施机制;从完善量刑建议的内容和程序、修订“一般应当采纳”的法律规定、健全判决后的救济程序三个方面完善制度设计,形成体现正当程序原则的完整制度体系。更多还原

【Abstract】 In an analysis of 426 cases of leniency system for admitting guilt and accepting punishment in the first instance and then entering retrial, it is found that the leniency system for admitting guilt and accepting punishment has played an important role in saving judicial resources, settling criminal cases,and ensuring the accuracy of conviction in the vast majority of cases. But there are also four obvious problems, namely, frequent low-level sentencing errors, high risk of inappropriate sentencing in serious felony cases, formalistic review of judges, and serious inadequacy of procedural guarantees for defendants.The main reasons for the above problems lie in the implementation mechanism and system design itself.The implementation mechanism should be improved from three aspects: improving the litigation connection mechanism and the internal restraint mechanism for sentencing recommendations, strengthening the legal assistance mechanism, and optimizing the case-handling performance evaluation mechanism of the procuratorial organs. the system design shall be improved from three aspects: perfecting the content and procedures of sentencing recommendations, abolishing the legislative provisions that “generally should be adopted”, and improving post-conviction relief procedures, so as to form a coordinated justice system.更多还原
