【摘要】 工程师是FIDIC合同中承担工程项目管理工作的重要角色,随着FIDIC 2017版合同的发布和工程师监理机制在工程项目中的广泛应用,研究FIDIC 2017版合同中工程师角色演变具有重大意义。文章基于FIDIC 1999版和2017版红皮书通用合同条件,采用文本分析及对比分析的方法研究FIDIC 2017版合同中工程师工作内容,深刻解析FIDIC 2017版红皮书中工程师的协调、决策、监管角色以及从FIDIC 1999版到2017版工程师在协调、决策、监管角色上的演变。文章关于工程角色演变的理论分析得到以下结论:工程师在协调、决策、监管角色中的工作内容都有了较大幅度的提升,相关规定更加详细和明确,更具可操作性。但是,随着实践中2017年版本的应用,工程师角色的演变是否在实践中能够提高项目实施效率与合同双方的公平感知仍需要进一步的实证研究。更多还原

【Abstract】 Engineer plays an important role in project management in FIDIC contracts. With the release of FIDIC 2017 contracts and the wide application of engineering supervision mechanism in engineering projects, it is of great significance to study the evolution of engineer’s role in FIDIC 2017 contracts. Based on FIDIC 1999 edition and 2017 edition Red Book General Conditions, this paper studies the work of engineer in the FIDIC 2017 Red Book by content analysis and comparative analysis, and deeply analyzes the coordination, decision and supervision roles of engineer in the FIDIC 2017 Red Book, as well as the evolution of engineer’s coordination, decision and supervision roles from FIDIC 1999 to 2017.The theoretical analysis of the evolution of the role of engineer in this paper draws the following conclusions: the work of the role of engineer in coordination, decision and supervision has been greatly improved, and the relevant regulations are more detailed, clearer, and more operable. However, with the application of the FIDIC 2017 edition in practice, further empirical research is needed to determine whether the evolution of engineer’s role can improve the efficiency of project implementation and the perception of fairness of both parties in the contract.更多还原
