【摘要】 体育纪律处罚权是体育组织一项非常重要的权力,对体育纪律处罚权的行使进行监督,既是权力必须受到监督的应有之义,也是保障受处罚者权利的需要。通过文献资料法、比较研究法,对体育纪律处罚的监督机制进行研究,研究表明:内部仲裁监督、外部仲裁监督、外部司法监督是目前体育纪律处罚3种主要的监督方式。用尽内部救济是寻求外部救济的前提条件,用尽内部救济后,外部救济途径存在单一制和双轨制2种模式。中国应该尽快完善自身的监督机制,建议进一步完善内部监督机制,长期目标应该是建立纪律处罚的外部仲裁监督和司法监督机制。更多还原

【Abstract】 Disciplinary actions are a very important right of sports organizations.To supervise the exercise of sports disciplinary rights is not only the due meaning that rights must be supervised,but also the need to protect the rights of those subject to disciplinary actions.Through the methods of documentation and comparative research,this paper studies the supervisory mechanism of sports disciplinary actions.The research shows that at present,there are three main supervisory methods for sports disciplinary actions:internal arbitration supervision,external arbitration supervision and external judicial supervision.Exhaustion of internal relief is a prerequisite for seeking external relief.After exhaustion of internal relief,there are two modes of external relief:single system and dualtrack system.China should improve its own supervisory mechanism as soon as possible.It is suggested that the internal supervisory mechanism should be further improved first.The long-term goal is to establish an external arbitration supervision and judicial supervision mechanism for disciplinary actions.更多还原
