【摘要】 职业联赛中存在很多问题,其中有关运动员与俱乐部之间的纠纷是本研究比较关注的问题,形式多种多样,但核心就是工作合同的争议以及运动员权益保障问题。从历次争议或者纠纷的结果来看,最终的受益者大多是俱乐部。究其原因,劳资双方地位不对等,运动员大多处于弱势地位是造成上述局面的直接原因。能否借鉴先进国家经验,组建运动员工会,以提高运动员集体力量,对抗资方的强势地位,为运动员争取合法权益,以最终促进职业体育的健康发展,是现阶段需要着重研究的问题。希望通过对相关概念和问题的分析,探讨我国职业运动员工会建立的可行性。更多还原

【Abstract】 There are many problems in the professional league. Among them,the dispute between athletes and clubs is a matter of concern to the author. There are many forms,but the core is the dispute over the work contract and the issue of the protection of athletes’ rights and interests. From the results of previous disputes or disputes,the ultimate beneficiaries are mostly clubs. The reason is that the status of both employers and employees is not equal,and the weak position of athletes is the direct cause of the above situation. Whether it is possible to draw on the experience of advanced countries and form a sports union to improve the collective strength of athletes,fight against the strong position of the capital,fight for the legitimate rights and interests of athletes,and finally promote the healthy development of professional sports is an issue that needs to be studied at this stage. This paper hopes to explore the feasibility of the establishment of professional sports staff in China through the analysis of relevant concepts and issues.更多还原
