【摘要】 西北民族地区社会治理具有特殊性,地理环境恶劣、特色的民族治理环境、复杂的民族价值观,造就了该区域传统社会治理中"情理法"的逻辑顺序和国家社会治理"法理情"的逻辑顺序有别,情理法存在冲突。这与西北民族地区社会治理中存在诸多问题有关,执法力量薄弱,执法盲点存在;民族干部比例失调,少数民族干部比例偏小;宗教信仰多元,宗教矛盾突出;村两委力量不均,政府公信力不够;调解机制不健全,法理情冲突时有发生。因此,西北民族地区社会治理情理法要合理调适,一是法治调适:加大普法力度,增强执法力量;二是队伍调适:均衡干部比例,借助乡贤治理;三是信仰调适:引导宗教团体,共建社会和谐;四是基层调适:优化村两委,提升公信力;五是机制调适:健全调解机制,规范法理情。通过对西北民族地区社会治理中情理法冲突的合理调适保障西北民族地区和谐稳定,更好地建设社会主义和谐社会。更多还原

【Abstract】 Social governance in the ethnic minority areas of northwest China has its particularity,whose harsh geographical features,special ethnic governance environment and complex ethnic values have created a logical order of"sympathy-reason-law"in the local social governance,which is different from the logical order of "law-reason-sympathy"in the national social governance. The conflicts among the three factors in this order are related to the following problems in the social governance of the ethnic minority areas of northwest China: weak law enforcement,blind spots in the law enforcement,a small ratio of ethnic minority cadres,religious pluralism and conflicts,poor administration of the village commission,poor credibility of the local government,inefficient mediating mechanism,legal conflicts related to "law-reason-sympathy". The solutions include the following: more legal education and law enforcement forces,a better proportion of the ethnic minority cadres with the help of good village governance,correct religious guidance for a harmonious society,improvement of the village commission and governance with more public trust,and better mechanism for governance and mediation. The solution to the "sympathy-reason-law"conflicts will stabilize the ethnic minority areas of northwest China and help build a harmonious socialist society for all.更多还原
