【摘要】 私有不可移动文物所有权人排斥文物保护的现象大量存在,究其原因,是现行文物立法对私有文物所有权进行了限制却缺乏必要补偿,损害了私有文物所有权人的权益。为平衡公私利益,提高所有权人保护文物的积极性,应建立文物保护补偿制度。以产权置换、委托代管、税收激励等方式对所有权人进行补偿,最终创造外部引导与内在自觉相结合的文物保护机制,让私有不可移动文物得到充分的保护。更多还原

【Abstract】 There are many phenomena of resisting the protection by private immovable cultural relics owner,one of the reason is that the existing legislation restricts the ownership of private cultural relics with no adequate compensation,which damage the rights and interests of the owner regarding the private immovable cultural relics. In order to balance the interests of the public and the private sector,and to arouse the enthusiasm of the private immovable property owners for protecting cultural relics,the compensation measures for the protection of cultural relics should be formulated. Determining the compensation subject,object,content and principles of compensation,and the owners of private immovable cultural relics,can be compensated through property right replacement,entrust,escrow and tax incentives. In this way,external guidance and inner consciousness of combining cultural relics protection mechanism can be provided. Finally,the best preservations will be achieved.更多还原
