【摘要】 法律是社区治理的制度依据和刚性保障。本文以内地城市社区治理模式的探索发展为切入点,指出其目前存在的立法困境。在考察归纳香港社区治理特点的基础上,强调香港社区治理立法对内地的启示。进而提出尽快确立规范城市社区地位的主干立法,合理界定政府管理与社区自治的法律边界;将基层协商民主明确为城市社区组织的法定决策程序;充分保障NGO(非政府组织)在社区治理中的法律地位等完善内地城市社区治理模式的立法建议。更多还原

【Abstract】 Law is the system basis and rigid guarantee in community governance. This paper first explores the urban community governance model of the mainland and analyzes its current legislative dilemmas.It then investigates and summarizes the characteristics of Hong Kong’ s community governance,and presents the implications of its community governance legislation for the mainland. Finally,it puts forward suggestions that the trunk legislation to regulate the status of urban communities should be set up as quickly as possible,the legal boundary of government administration and community autonomy should be defined reasonably,the grassroots deliberative democracy of urban community organizations should be regarded as the legal decision procedure,the legal position of non-governmental organizations( NGO) in community governance should be protected and the mainland urban community governance model should be improved.更多还原
