【摘要】 微博是信息化、网络化时代产生的一种新媒体。它是一把双刃剑,其价值及影响需要我们理性地评判。在正确的导向和规范下,它可以成为虚拟开放社交的载体、信息资源共享的渠道、助人维权的平台、舆论监督的媒介。但是其一旦失范,将会产生负面的社会效应,主要表现为侵害精神性人格权、侵犯知识产权、违反程序正义、消极的舆论导向、“群体极化”效应。微博的规范化建设必须加快微博的立法建设、加强微博“把关人”的制度建设、引领微博社区的自律建设。更多还原

【Abstract】 Microblog is a new media growing out of the era of informatization and network. It is a double sword,so its value and influence needs us to evaluate reasonably. Under correct orientation and specification,microblog may be the vehicle for virtual and open social interactions,the channel of information resource sharing,the platform of helping to protect the rights and the medium of the public supervision. But once microblog is in anomie,it will produce negative effects,which include encroaching on the spiritual rights of personality,infringing upon the intellectual property,violating the procedural justice,misleading the direction of public opinion and producing the effect of“group polarization”. So,the standardization construction is obliged to accelerate the legislation of microblog,strengthen the construction of the microblog as“gatekeeper”and to lead the self-discipline of the microblog as a community.更多还原
