【摘要】 在高校建设档案收集中面临着法规相冲突的情况,一方面是高校档案馆依据《中华人民共和国档案法》,要求建设部门保证建设档案齐全、完整;另一方面是城建档案馆依据《城市建设档案管理规定》,要求高校将所有建设档案移交归档。因此,要解决这一矛盾冲突,就需要利用相关法律原则。从法律效力和法条适用性两方面来界定高校建设档案的归属,从档案的利用价值来平衡两馆馆藏,既有利于档案利用,又有利于档案留史保存,避免出现馆藏一边倒的现象。更多还原

【Abstract】 There are many conflicts between different laws and regulations in the collection of colleges’ construction archives. For one thing, college archives require capital construction departments to ensure that the infrastructure file is complete, according to The Archives Law of People’s Republic of China. For another, urban construction archives require capital construction departments to hand over all of the construction archives, according to The Urban Construction Archives Regulations. Therefore, to resolve this contradiction, we need to use the relevant legal principles. The ownership of the colleges construction archives should be defined from the legal effect and the applicability. And the two collections should be balanced. All of this are more beneficial for utilization and preservation of archives, and can avoid the phenomenon of one-sided collection.更多还原
