【摘要】 行政自由裁量权是行政主体在外在法治与内在伦理精神的指引下,以追求公共利益最大化为目标,对行政主体一种积极限制和积极自由的统一。这种定位因行政理性的限度,"委托—代理"双方信息不对称致使权力寻租现象出现和相机抉择的时滞作用等原因而出现错位。而通过强化信息素养、厘清权力边界进而压缩寻租空间,建设责任、效能政府等方面入手,为自由裁量权的复位提供合法性前提。更多还原

【Abstract】 Administrative discretion is a unification of the administrative subject combining positive restriction and positive freedom,under the guidance of the external rule of law and internal ethics spirit for the goal of maximizing the pursuit of the public interest.This positioning will become mal-positioning because of power rent seeking and time-lag of discretionary approaches caused by the limitation of the administrative rationality and information asymmetry between the principal and the agent.A legal basis for the resetting of the discretion is to be provided by strengthening information literacy,clarifying the boundaries of power and compressing rent-seeking space as well as constructing a responsible and efficient government.更多还原
