论我国房屋中介服务立法之完善
The Legislation Perfection of Housing Intermediary Service in China
【摘要】 当前,我国房屋中介服务行业方兴未艾,房屋中介的广阔市场促成了房屋中介服务机构数不胜数。房屋中介作为为当事人提供房屋信息咨询、价格评估、经纪代理等服务的专门机构,在发展的过程中存在诸多问题,如隐瞒交易信息,误导客户交易;房屋中介服务合同不规范,不利于客户权益保护;制造虚假信息,诱导客户等等。为了不断完善我国房屋中介服务立法,可以从明确规定房屋中介服务当事人的告知义务、强化房屋中介服务合同的规范性、提高房屋中介服务的公开性和透明性进行完善,以期对我国房屋中介服务立法发展有所裨益。
【Abstract】 At present,the industry of China’s housing intermediary service has been developing continuously. The broader market of housing intermediary has contributed to the housing intermediary service institutions. As the specialized agencies of providing housing information consultation,price assessment,brokerage agent services,it has many problems exist in the process of development,such as hiding trading information,mislead customers; housing intermediary service contract is not standard,not conducive to protection of the rights and interests of clients; making false information,inducing customers and so on. In order to improve the housing intermediary service legislation in our country. This paper defined housing intermediary service with the obligation of the parties to strengthen the housing intermediary service contract standardization and improve the housing intermediary service of openness and transparency. It puts forward some thoughts,such as to help the perfection of the housing intermediary service of legislation in China.
