【摘要】 "医疗机构列入公共场所"提案意在降低扰乱医疗机构秩序行为的入罪门槛,试图通过刑法的惩罚和威慑功能保护医务人员,维护医疗秩序。现行法律并不存在对涉医违法犯罪案件规制的空白,提案有违刑法谦抑性理念。预防和控制涉医违法犯罪行为,在依现行法律严格执法和司法的同时,还应当通过完善公力救济渠道、提升医疗信息对称性、推进医疗资源公平合理分配等途径解决根本问题。更多还原

【Abstract】 The proposal of"medical institution involved in public places"is aimed to protect medical staffs and keep order in medical institutions by penalty and warning from criminal law.There is no margin in available legal documents on regulating offences and crimes on medical services.The proposal is contradictory with restrictive spirit of criminal law.In order to prevent and restrain offences and crimes on medical services,some countermeasures should be put forward,such as perfecting the way of public remedy,promoting medical information symmetry,advancing fair and reasonable allocation of medical resources.更多还原
