【摘要】 法治政府建立的前提是政府责任的法制化,政府责任法制化的前提则是政府责任的法定化:法律明文规定政府是否承担法律责任,承担何种法律责任,同时保证法律自身的完整性、有效性与正当性。法的生命在于执行,法的效力不等于法的实效,若确保政府环境保护责任的实现,必须完善相关法律机制,完成由"纸面上的法"向"行动中的法"的转变,而要完成这种转变,需构建一套制约与激励并存的环境法律实施机制。更多还原

【Abstract】 The precondition for establishing a legal government is to legalize the government’s responsibilities.And the precondition for the latter is the legalization of government’s role.That is at least two elements should be guaranteed if the government is expected to bear more legal responsibilities.Firstly,the law mandates whether government should be responsible of criminal liability and what kind of criminal liability they should bear,which is the legalization of government’s role of protecting the environment At the same time,ensuring the integrity,effectiveness and legitimacy of law itself is vital as well.Secondly,the life of law lies on implementation.The effect of law is not equal to the actual effect of law.In order to ensure the realization of government’s role of protecting the environment,relevant legal mechanism must be perfected as well as the transition from "law in paper" to "law implemented into action".There is no doubt that establishing an environmental law implementation system with a combination of incentive and restriction,so as to accomplish this transition,is vital and necessary.更多还原
