【摘要】 在清代的刑事证据中,言辞证据是非常重要的一类,而以往对言辞证据采集的专题性研究较为缺乏。采用规范研究和实证研究的方法,以言辞证据采集的时间、地点、对象和手段为涉猎的主要内容,对清朝言辞证据采集的制度规定和判例判牍进行分析,可以看出,清朝言辞证据采集的制度规定已经较为完善,实践经验已经相当丰富,但也存在着法律规定和实际操作的背离。希望通过对清朝言辞证据采集的探讨,为清朝刑事证据的整体研究提供借鉴。更多还原

【Abstract】 Oral evidence was one of the most important criminal ones in the Qing Dynasty.However,the monographic study for the collection of oral evidence lacked before.The main content of this article include the time,place,objects,and means of collection,and normative and empirical research methods are used.By analyzing the law and cases,we can conclude that the system was featured by its relative completeness and rich practical base.But,the question of the department between law and practices existed.The article attempts to provide a reference for the integrated research of the Qing Dynasty’s criminal evidence by means of the discussion of the collection of oral evidence.更多还原
