【摘要】 《经2010年修正的1978年海员培训、发证和值班标准国际公约》已于2012年1月1日生效并适用于我国。为研究并证明我国新的海船船员考试发证规则对该修正案的满足程度,在全面理解新规则和新修正案的基础上,提取了船员适任发证制度的核心要素和内容,并对比研究了《新规则》在这些方面对于新修正案的符合程度。研究结果表明,我国海船船员适任考试新规则能够全面地满足新修正案的要求。分析研究还提供了一种有助于判断国内规则对于类似于STCW公约立法特点的海事公约的总体符合程度的证明思路和方法。更多还原

【Abstract】 The International Convention on Standards of Training,Certification and Watch keeping for Seafarers,1978 was amended in 2010 in Manila(the new amendments) and has been effective since the 1st of Jan.,2012.China is one of the signatories.To investigate the extent of conformity of the new regulation of competency examination and certification of China with the new STCW amendments,a set of key elements in the new certification standards is compared with that of the convention amendments.The study proves that the new regulation of China is fully complied with the new STCW amendments.Besides,the study provides an effective methodology to verify the conformity of a domestic regulation with comprehensive and systematic conventions similar to STCW.更多还原
