【摘要】 原因债权基于原因法律关系发生,票据债权基于票据法律关系发生。为了清偿原因债务而授受票据时,债权人与债务人之间出现双重债权:原因债权和票据债权。债权人应先行使票据债权,票据遭拒绝付款或承兑时始得行使原因债权。债权人行使原因债权,在原因债权履行期限早于票据到期日届至时,应认为原因债权的履行期限为当事人合意延迟至票据到期日;在原因债权履行期限晚于票据到期日届至时,应解释为原因债务的履行期限提前至票据的到期日,债务人在票据到期日前提前清偿原因债务的,债权人可以拒绝受领。更多还原

【Abstract】 Causal creditor’s right occurs in the causal relations of a negotiable instrument,while bill right occurs in bill relation.When receiving negotiable instrument to pay off causal creditor’s right,dual-creditor’s right occurs between the creditor and the debtor:causal creditor’s right and bill right.The creditor should first exercise bill right,and then causal creditor’s right in case the negotiable instrument is refused to pay off or honor.When the creditor exercises causal creditor’s right,if the deadline for performance of causal creditor’s right comes earlier than expiring date of negotiable instrument,we should regard the deadline for performance of causal creditor’s right as deferred to the maturity of negotiable instrument by consensual parties;otherwise,we should regard the deadline for performance of causal debts as prior to the maturity of negotiable instrument,and in this case,if the debtor pays off causal debts before maturity of the negotiable instrument,the creditor can refuse to accept.更多还原
