【摘要】 通过对资源的社会性内涵进行研究,指出人类共同拥有一个地球,资源属于全社会成员共同所有;任何人都有合理、节约、高效利用资源的义务,而没有浪费资源的权利;由于资源具有的这种社会性,应通过对其利用最大限度地增加社会的整体福利。报告了目前我国大量空置房对资源社会性的背离的现状是对社会的整体福利的严重损害。提出了国家通过法律对房屋权利人的资源浪费行为进行规制,以满足资源社会性要求的相关对策:一方面在已有制度的贯彻落实上关注资源的社会性,改变只重经济效益的价值取向;另一方面完善我国住房税收制度,开征房产税,建立房屋空置行政处罚及强制回购制度,满足资源的社会性要求。更多还原

【Abstract】 By studying the resource scoiality,the paper points out that earth and resources are shared by all human beings around the world.Because of the sociality,resources should be used maximally in order to increase the public welfare wholly.It is the obligation for everybody to utilize resources rationally,economically and efficiently,but not to have the right to waste them.However,the resource sociality has been deviated because lots of vacant houses appeared,which greatly harms the social welfare.Therefore,regulations must be formulated to regulate house holder’s behaviors to help them be aware of the resource sociality.On the one hand,the nature of resource sociality deserves attention and economy-focus value should be changed during carrying out the already existing regulations;on the other hand,the housing tax system should be improved with the measure of collecting house property tax,and the system of administrative punishment and compulsory repurchase for housing vacancy should be formulated to meet the resource sociality.更多还原
