【Abstract】 Answering truthfully and the right to silence, as a specific legal system, belongs to the "man-made objects" and have a specific function. However, they are the product of culture in stead of any design objects. Functional analysis solves such a problem as what roles answering truthfully and the right to silence play in the lawsuit structure. Culture can explain value judgment that contains in answering truthfully and the right to silence. To "annul" or to "establish" answering truthfully and the right to silence ultimately depends on the cultural value judgment.更多还原
