【摘要】 随着地球资源短缺问题的日益突出,月球以其丰富的资源和近地性不断吸引着人类的开发和探索,然而国际社会目前还缺乏一套完整的、统一的、有约束力的法律体制。从现有的国际公共领域资源开发法律体制和现有月球开发法律规范的研究出发,建议在月球开发法律体制的构建中,以开发的不同时期为维度,以便为构建月球开发新的法律体制献言献策,进而为各国的月球开发活动提供一些参考性的指导。更多还原

【Abstract】 The shortage of earth’s resources is becoming increasingly prominent,therefore,the moon has been studied and explored for its rich resources and near-earth nature.However,there is still not a comprehensive,uniform and binding legal framework in the international society.The paper cited the existing legal systems for the development of international public resources and moon resources.Moreover,it proposed that in the construction of the new legal system,different emphases in different phases of moon development should be fully considered.In the prophase,the Moon Development Authority should be a choice for the management of moon development activities;during the medium term,"the common heritage of intelligent beings in the universe principle," "the principle of Non-Military" and "the principle of environmental protection" should be consolidated and supported;in the post-development period,a compensation mechanism named Moon Development Fund Committee should be adopted to ensure the risks to be shouldered by space countries together..更多还原
