【摘要】 报复性执法是指拥有行政执法权的行政主体及其工作人员在执法过程中,因为非法利益得不到满足或受到"损害",滥用职权,报复性地适用法律,损害行政相对人合法权益的行为。报复性执法是选择性执法的一种。其原因主要是法律赋予行政主体的自由裁量权过大,对行政主体的监督较少,另外还有行政管理体制等方面的原因。更多还原

【Abstract】 In the process of law enforcement,when the illegal benefits of the administrative body of the law enforcement and its staff are not met or "damaged",they tend to abuse their powers and apply the law in the retaliatory way,thus harming the legitimate rights and interests of the counterparts.Retaliatory law enforcement is one sort of selective enforcements.The main cause of this phenomenon is that the free decision-making power granted by the law to the administrative body of the law enforcement is too much,the supervision to the administrative body is weak and the administrative system is not effective.更多还原
