【摘要】 近20年来,由于法制体系的建立与完善,人们保护野生动物的意识不断增强以及生物多样性保护工作的推进,我国的生态环境和野生动物栖息地得到很大改善,一些重点野生动物资源得到恢复,导致原有的栖息地容量不足甚至饱和,伤人损物事件时有发生,造成野生动物肇事事件。有效地保护重点野生动物,维护受害群众的权益,成为各级政府以及野生动物保护部门的一大难题,同时也是各界人士关注的热点问题。本文就我国野生动物肇事涉及的有关法律及经济补偿问题,以及一些省(区)重点保护陆生野生动物造成人身财产损害补偿办法中有关的法规依据进行了探讨,并分析了野生动物肇事补偿中的相关问题,提出需要修改相关的法规和完善补偿制度等。更多还原

【Abstract】 In recent 20 years,with the establishment of law system,improvement of consciousness on wildlife conservation and advancement of biodiversity conservation,the ecological environment and habitat of wild animals have been improved obviously,and wild animal resources are recovered.These cause the population of wild animals enlarges and the capacity of their habitat is saturated or even not enough.Accidents of wild animals cause troubles happen now and then.To effectively protect wild animal as well as the interests of people has become an important problem to the governments at all levels and departments of the wild life conservation.This paper aims to study related law issues of wild animal damages such as Wild Animal Protection Law of the People’s Republic of China,Property Law,Budget Implementation Regulations and economic compensation cases of key protection wild animal causing damages on human body or/and property in provinces(regions).Compensation problems of wild animal accidents such as subject,object,measure,criterion are analyzed.Suggestions on compensation problems of law system,economic compensation and improvement are put forward.更多还原
