【摘要】 《保护和促进文化表现形式的多样性公约》作为国际社会首个专门针对文化多样性并涉及文化产品和贸易的公约,对文化贸易的国际规制将会产生重要影响。该公约虽然为各国保护文化产业和文化贸易提供了法律依据,但是并不能有效地保证文化多样性在全球范围内得到广泛保护。从文化贸易争端解决途径来看,公约规定的争端解决机制与WTO的争端解决机制相比先天不足,这将导致文化贸易争端的最终解决可能仍需要诉诸于WTO争端解决机构,结果会使公约的正面作用被严重削弱。更多还原

【Abstract】 This paper studies the background and content of UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions,the first convention concerning cultural diversity and cultural trade,which has a substantial impact on the international regulations on cultural trade.Although the Convention provides the legal basis for the contraction parties to protect their cultural industry and trade,it can not effectively guarantee the worldwide protection of cultural diversity.In light of measures of disputes settlement of cultural trade and compared with the dispute settlement system of WTO,that of the Convention has its inborn defects;and the final solution to disputes in cultural trade might still resort to the WTO Dispute Settlement Mechanism,which will seriously weaken the positive function of the Convention.更多还原
