台湾土地法律体系及其对大陆土地立法的启示

【摘要】 研究目的:总结台湾土地法律体系,分析其对大陆土地法律体系建设的启示。研究方法:文献资料法、归纳分析法、比较分析法。研究结论:(1)台湾狭义土地法律法规体系可归纳为地权、地籍、土地使用、地价地税和土地征收5个方面。(2)台湾土地法律体系比较完善,对大陆建立和完善土地法律体系有参考价值。

【Abstract】 The purpose of this paper is to review the Taiwan land law system and analyze its enlightenment for the construction of land law system in China’s mainland.Methods of documentation,induction and comparative analysis were employed.The results show that the Taiwan land law system can be summarized as land ownership,cadastre,land use,land price & taxation and land expropriation.Taiwan land law system is comparatively integrated and can be taken for reference for China’s mainland.
