【Abstract】 Circumstance is an important issue in the study of criminal law.While present studies have not gotten a common sense on the definition of circumstance,this article tries to analyze some representative definitions in the research background of criminal law and argues the defects of the general definition and suggests the resolutions as well.In conclusion,the article perceives the definition of circumstance: Circumstance is facts which represent the level of the actor’s negative will towards the value protected by the criminal law.更多还原
