【摘要】 近年来,专利池已成为发达国家对我国发动标准和专利战的主角.在此,对专利池的概念作了界定,回顾了专利池的发展沿革,分析专利池形成的原因并对现代专利池的再度兴起提出自己的见解.以国际上典型的专利池为例,全面阐释现代专利池的组建与运作机制;分析比较了美、欧、日、台湾等国家和地区对专利池知识产权滥用的法律规制,并提出我国的相应对策.更多还原

【Abstract】 In recent years,patent pool has become vanguard of west countries in the patent & standard war against our country.It first defines the concept of patent pool,reviews the development history of patent pools and analyse the causes of the formation of patent pool and re-emergence of modern patent pool.Then,it takes typical current international patent pools as examples to explain the formation and operation mechanism of the modern patent pool.Finally it analyzes and compares the law regulation on patent pool in U.S.,Europe,Japan and Taiwan,and put forwards some strategies of response.更多还原
