浅析欧盟法与成员国国内法的关系
Reflections on the Relationship between EU Law and Domestic Law of EU Members
【摘要】 在欧盟内部,存在着欧盟法和成员国国内法两个相互独立的法律体系。欧盟法在其成员国国内具有直接适用效力,并居于优先地位;在立法权力的划分上则适用先占原则和附属原则。欧盟法独特适用方式表明欧盟法已经成为一个独特的、自成一体的法律体系。
【Abstract】 In EU there exists two independent legal systems,namely,EU law and its members law.EU law can be applicable to every member and enjoys priority of application.The principle of preemption and subsidiarity are adopted in the division of legislation.The unique way of application of EU law demonstrates that it has become a independent legal system.
