【摘要】 随着世界经济的全球化、信息化和一体化的加强,知识产权保护对国际直接投资起着越来越重要的作用。在国际直接投资有关的知识产权保护中,存在着制度层面保护发达国家利益倾向的问题和实践层面发达国家的知识产权反竞争行为和对发展中国家的知识产权“淡化”和控制等问题。要科学地实现国际直接投资中的知识产权保护,各个国家,尤其是发展中国家应当确立科学的国际直接投资有关的知识产权保护价值取向,实行知识产权的适度保护、禁止滥用,从根本上提高国家和企业自主创新能力,积极应对各种国际直接投资中的知识产权争议。更多还原

【Abstract】 With the strengthen of globalization,information and integration with the world economy,the intellectual property protection is playing more and more important role in international direct investment.In the intellectual property protection of FDI,the problems embody that the IPR system has the tendency of protecting the developed countries and that in the practical aspect the developed countries abuse the rights of IPR and the intellectual property rights of developing countries have been blunted and controlled,etc.To realize the scientific protection of IPR in FDI,the countries,especially the developing countries should establish the right value orientation,implement the moderate protection of IPR in FDI and prohibit the abusing the IPR;fundamentally enhance independent innovation ability of nations and enterprises;positively solve all kinds of IPR disputes in FDI.更多还原
