【摘要】 国家援助是一国政府利用国家财源给予企业的支持。由于国家援助可能对市场竞争态势产生实质性的影响,欧盟各成员国的国家援助就成为欧盟竞争法的规制对象。修订后的《建立欧洲共同体条约》第87-89条针对国家援助问题做了规定。此外,欧盟委员会等欧盟机构在上述条约规定的基础上也通过了一批条例、指令和决定等;欧洲法院也积累了许多判例。欧盟的国家援助控制制度已比较完备,作为欧盟竞争法的一部分,对我国竞争法的完善颇具借鉴价值。更多还原

【Abstract】 State aids refer to support measures granted by the state through state resources to industries. Aids from a member state may produce substantial influence on the competition situation of the market and therefore fall into the scope of regulation of European competition law. Articles 87-89 of the Treaty Establishing the European Community (consolidated version) make provisions in this respect and the European institutions such as the European Commission have adopted some secondary legislation. The European Court has also judged some cases. The European state aids control system,as part of European competition law,may have great reference values to Chinese competition law.更多还原
