【Abstract】 Based on modem constitutional idea, in order to safeguard the economic freedom of the market subject, and at the same time to regulate the economic modulation behavior of the government, we must endow the market subject with the economic right and demarcate the boundary of the government’s economic power, which is the first important matter of the economic constitution, and also only when the constitution truly fulfills its morals pledges, truly determines government institution’s economic duty to the all citizens and limits the economic power, the economic constitution has the legitimacy. The analysis for the legitimacy of the legal right in the Economic law must be launched under this premise, only then can constructs the harmonious market economic order and the rational right (power) structure, and makes the market economic subject to conform with the selection of nature, realizes the self- economic welfare.更多还原
