【摘要】 近几年,各类重大责任事故频发,使重大责任事故罪成为备受关注的焦点。就责任事故犯罪的主体而言,有的国家规定部分责任事故犯罪可以由单位构成,如法国和西班牙;而有的国家则不承认责任事故犯罪中单位的犯罪主体地位,如日本、俄罗斯和我国。从严密刑事法网、更好地预防和控制重大责任事故犯罪的角度出发,单位应当可以成为我国重大责任事故罪的主体。更多还原

【Abstract】 In recent years,the study of negligently causing serious accident crime(NCSA) becomes the focus of attention for the frequent occurrence of various serious accidents arising from negligence.This article specially studies the subject scope of it.Through the legal case review of the units composing the subject of NCSA crime abroad and the study on major cases of NCSA crime at home,the article points out that the unit should be regarded as the subject of NCSA crime in order to strictly keep the meshes of criminal law and prevent and control the same crime.更多还原
