公司、企业人员受贿罪中的“为他人谋取利益”
On Connotation of Seeking Profit for another in the Crime of Acceptance of Company or Enterprise Personnel
【摘要】 不管是索贿型公司、企业人员受贿罪,还是收受贿赂型公司、企业人员受贿罪,“为他人谋取利益”都是其构成要件。“为他人谋取利益”是客观要件;是否“为他人谋取利益”影响公司、企业人员受贿罪既遂的成立。
【Abstract】 This article demonstrates that seeking profit for another is a necessary constitution wherever in the crime of acceptance to demand bribery or in the crime of acceptance to receive others’ property.Seeking profit for another is the objective constitution of the crime of acceptance of company or enterprise personnel.Whether seeking profit for another or not,it affects the establishment of accomplished offense.
