【摘要】 “信访洪峰”是我国在经济社会转型期民主与法治建设滞后、政府社会管理和公共服务滞后、社会利益协调机制构架滞后的集中体现。信访制度改革应同整个宏观体制改革结合起来,从我国实际出发,以法治为核心实行渐进性的制度创新。文章在分析信访制度性质的基础上,认为转型期信访制度的功能应定位在利益表达、纠纷化解和权利救济上,按照党政、人大、司法的机构性质和基本定位,重整信访的组织体系和权力结构,探索信访与法治契合的可能路径,形成三位一体、各司其职的信访新格局。更多还原

【Abstract】 The rush of ’letter and visit’ reflects the delay of democracy and rule of law,social management of government and public service,even more the social interest negotiation mechanism.Hence,’letter and visit’ institution reform should unify the macro-institution background,and consider the rule of law as the central part of gradual innovation,according to the situation of our country.The main purpose of this paper is to find the possible way of putting the ’letter and visit’ into the rule of law,the new pattern of putting the party and government,the national people’ congress,judicature in the right place,according to the character and function of the three departments,in our age and reality.更多还原
