【摘要】 我国现行《刑法》和相关司法解释,只是把盗窃数额较大或次数较多的盗窃行为规定为盗窃罪。但很多入户盗窃行为,仅以以上标准难以对其进行定罪处罚。而这种行为社会危害性极大,因此,文章建议对入户盗窃行为不以数额和次数为标准,一经出现,即应定为盗窃罪。更多还原

【Abstract】 As for our current ’Criminal Law’ and rational legal comment, the larceny is limitedly defined that some great larcenist or recidivist.While many indoor theft,it is very difficult to criminate those of larceny according to the above standard.But such indoor theft does great harm to the society.Therefore,this paper proposes that it should not follow the standard of the amount and the frequency but follow the appearance of indoor theft.更多还原
