【摘要】 医疗责任保险与医疗侵权责任有着密切的联系 ,两者相互促进、相互影响。医疗责任保险有利于减轻医院的损害赔偿责任和强化医疗侵权责任的赔偿功能 ,从而在一定程度上弥补侵权责任在解决医疗纠纷中的局限性。同时 ,医疗责任保险也可能弱化医疗侵权责任制度的事故预防功能 ,因而有必要正确认识医疗责任保险在实施过程中可能产生的弊端。更多还原

【Abstract】 Medical liability insurance is closely related with medical tort liability. They promote and affect each other. Medical liability insurance is help for relieving hospital’s responsibility of compensation for damage and strengthening the function of compensation of medical tort liability, which remedy the limitation of medical tort liability for solving medical dissensions to some degree. Meanwhile, medical liability insurance might weaken the function of accidence prevention of medical tort liability system.
