【摘要】 目前 ,旅游业得到空前发展 ,然而旅行社民事侵权事件也时有发生。此类事件 ,轻则影响旅游者心情 ,重则造成重大经济损失 ,甚至人员伤亡 ,极大地影响了人们的旅游质量 ,侵害了旅游者的合法权益。作者从旅行社和导游之间的法律关系出发进行论述 ,反对“代表论”和“代理论”的观点 ,认为导游在执行职务时导致他人权益损害 ,旅行社应承担民事侵权责任 ,由此提出导游“执行职务论”。更多还原

【Abstract】 At present, tourist industry has made an unprecedented development, but the travel agency’s tort happens occasionally. Fortunately, these incidents influence the tourists’ mood, to be serious, cause great economic losses, even casualties, affecting people’s quality of the travel greatly, encroaching upon tourists’ legal rights and interests. With discussing the legal relationship between the travel agency and the tour guide, the author argues against the theory of the guide possessing not only the right of representation, but that of agent. The author believes the travel agency must bear the responsibility for the tort, resulting from the tour guide’s fault when performing the duties. Therefore, the paper theorizes a new theory on performance of the duties.更多还原
