【摘要】 居住权是传统大陆法系国家民法典中的一项重要的物权制度,在西法东渐时却没有被我国民法所借鉴。在物权法草案的讨论过程中,学界对于是否引入居住权意见不一。文章从分析居住权的概念及其源流入手,探讨了我国是否能够引入居住权以及如何在立法体例和具体内容上设计居住权诸问题,以期能为居住权这一理论争议提供解决方案。更多还原

【Abstract】 Habitation is an important property regime prescribed by the codes of traditional continental law countries, but it has not been introduced into China all the while “the eastern countries are learning from western laws”. There still remain disagreements with its introduction while scholars are deliberating the draft of the Chinese Property Act. On a brief review of the concept and its origin and evolution, this article offers some measures to reconcile the differences, examines whether China can introduce habitation and how to settle problems in respect of relevant statutory framework and specific contents.更多还原
