【摘要】 在中国古代法律形成时期各部落规则的博弈中 ,士以“巫史”的身份对信息的收集、保存、整理、解说工作做过不少努力 ,并对各部落之间博弈的类型及策略的选择起了关键作用 ,进而影响了中国古代传统法律的气质。春秋战国之际 ,士大夫以手中的文化资源参与游戏 ,以思想影响政治。儒家、法家积极参与政治游戏 ,而道家则放弃了游戏。汉代以后的法律儒家化 ,表明儒法两家陷入“囚徒困境” ,不得不相互妥协更多还原

【Abstract】 In the Chinese ancient law formation periods and in the rules gaming of different tribes, scholars played an important role in collecting, storing, sorting and commenting information and selecting the classifications and strategies of the game between the different tribes and this influenced the spirit of Chinese ancient laws. In the Spring and Autumn Warring States Periods, the scholar-officials took part in the game with cultural resources in hand and influenced politics with their thoughts. The Confucianists and Legalists actively took part in this political game, and the Taoists abandoned this game. The law after Han-dynasty displayed that both the Confucianists and Legalists found themselves tightly combined and compromised.更多还原
