【摘要】 盖然性证明标准是一个客观化的概念 ,主要依赖于概率或经验的手段来判断法官的心证是否达到了法定的强度 ,但是 ,心证是法官主观上高度抽象的思维活动 ,以客观的手段来量化是不能成功的。学者以两大法系的理论来论证盖然性证明标准存在的合理性也存在疑问。因此 ,我国证据法应以法官是否形成内心确信来替代盖然性证明标准。更多还原

【Abstract】 Prevailing Proof Standards” is an objective concept, which mainly depends on the probability rate and relating experience to decide whether the judge’s evaluation of evidence is legal or not. However, the evaluation of evidence is an abstract thinking of the judge, and it is difficult to measure evidence with objective means. The author puts forward his doubt on the rationale of the existence of the prevailing proof standards through analyzing the theories of both Continental Legal System and American Legal System. Consequently, Chinese evidence law should be based on the inner conviction of the judges instead of the prevailing proof standards.更多还原
