【摘要】 关于物权法的基本原则,学者多有争论,但物权的优先效力是得到学者一致肯定的,仅对于优先效力的内容、表现以及与其他效力的关系,存有疑问。笔者试图对物权的优先效力相关问题给出自己的理解:物权的效力包括排他效力、优先效力、追及效力和物权请求权效力,四效力产生的共同基础在于物权的支配性。物权的优先效力和排他效力各自独立,物权的优先效力包括物权优先于债权和物权之间的顺序优先。更多还原

【Abstract】 Scholars argue on the principles of property rights while agreeing on the preferential effect of property rights except the issue on the content and the representation as well as the relation between the preferential effect and other effects, Here the author tries to give his own interpretation of the relevant problems: exclusive effect, preferential effect, chasable effect and pleading effect. Their common basis lies in the domination of property rights. The exclusive effect of property rights isindependent against the preferential effect which includes two kinds of state---the preference of property rights to creditor’srights and the preferential order among properties.更多还原
