【摘要】 我国的审判制度自产生以来 ,一直是行政和审判合一的 ,审判从属于行政。法官本应是职业的法官 ,但我国的法官非职业化现象严重 ,特别是法官管理的官僚化现象十分严重。 2 0世纪以来 ,我国大力推行了一系列司法改革 ,但囿于政治体制方面的原因 ,司法独立 ,特别是法官独立问题始终未能解决 ,法官的官僚化仍然存在。因此 ,我国的司法改革要想达到公平公正的目标 ,不仅要从形式上保障司法独立 ,而且还应从实质上保障司法独立 ,特别是法官的独立。彻底摒弃法官的官僚化 ,还法官职业化的本来面目更多还原

【Abstract】 In recent years, the reform of court system is developing dramatically.Especially the reform in field of judging form has already presented its firstling.The next step followed is the feform of the personnel system of court,which will be the key matter of the whole reform in court.Experts and scholars are arguing how this reform be proceeded appropriately.This article tries to use the experience of advanced countries such as the Uunited States and Japan for reference and do analysis on following issues:selection and appointment of judge;the hierarchy for judge;the form of judiciary administration and organization;allocation of jurisdiction and the relationship between superior and inferior court.Established in benefit to reform resolution to the reality and future in China,this article puts forward reasonable advices to speed the judiciary administration system transfering from the predicament of "ruling by man" to "ruling by law".更多还原
