【摘要】 基本人权的发展历程坎坷,从人权思想到人权学说再到宪法化实践。但对基本人权的界定尚有争议,笔者认为:凡宪法规定的公民权利皆基本人权,我们称之为宪法化的公民权利,但尚有公民权利应宪法化而未宪法化。基本人权的根本属性决定了基本人权是宪法的终极追求。我国不仅要完善宪法基本人权之规定———从应有人权到法定人权,还要建立基本人权的宪法保障制度———从法定人权到现实人权。更多还原

【Abstract】 Basic rights have undergone a thorny process,from the concept of basic rights,through basic rights theory,to the constitution enforcement of basic rights.However,the definition of basic rights is still at issue.We hold that each of the rights stipulated in the constitution is basic rights.Yet the enumeration of these rights shall not be construed to deny or disparaged others retained by the people.It is the ultimate pursuit of the constitution to safeguard basic rights,which is determined by basic rights’attributes and manifested by the ultimateness of basic rights in comparison with state power.更多还原
