【Abstract】 Civil basic system embodlies internal demand of right that bases on social material living conditions. And it is used as general principle of members association in civil society. Nacting civil law should base on-recognizing due right that is sciential starting point of confirming of right, absorbing demands of right which comefrom social material living conditions, constructing new civil legal system.
